Off-label marketing promotes use associated with significantly heightened rates of adverse effects that have been demonstrated to be substantially increased in off-label use in general, 17 and are particularly heightened in children. 10 Off-label marketing, on the other hand, can harm patients, third-party payors, competitor manufacturers, and researchers and clinicians in multiple ways ( Box 1, Central Illustration).Īspects and Consequences of Off-Label Marketing Schemes In 2007, the FDA found that 60% of drug-eluting stent placements were off-label, and that off-label use was associated with increased adverse events (although to be fair, off-label placements may well have generally occurred in more complex patients, who might already be at elevated risk for adverse events). 12, 13 Off-label device use is well known in cardiology: off-label use of cardiac and vascular stents, 10, 14 pulmonary vasodilators 15 and percutaneous cardiac replacement valves 16 are well known and useful in device-mediated treatment innovations. 10 However, off-label marketing also plagues the medical device industry, as evidenced in whistle-blower lawsuits (so-called Qui Tam law suits), 11 and recent increased scrutiny by government prosecutors in the FDA, the Office of the Inspector General, and the Department of Justice on marketing practices in the medical device industry. Yet clinical phase studies constitute on average <1% of a drug’s total development costs (even during initial approval), 6, 7 and the process of obtaining approval for additional use is generally shorter and less expensive than initial approval, because preclinical development is already complete and in the case of drug development early toxicity studies have already been performed.ĭespite regulations prohibiting off-label marketing, a 2009 review found that off-label drug marketing occurred across “multiple manufacturers of various sizes and drugs in virtually every therapeutic class.” 8, 9 The prevalence of off-label promotion and use of medical devices and outcomes is less well studied and understood than off-label promotion and use of pharmaceuticals. Most companies do not seek expansion of FDA-approved indications after initial approval, allegedly due to the time and expense required. It is illegal to promote or advertise use of a drug or device for anything other than its FDA-approved use, an act termed “misbranding.” 4, 5 To legally broaden the uses for which a drug or device can be advertised, the manufacturer must apply to the FDA and present evidence of safety and efficacy. Off-label use by a physician or other prescriber is legal, 3 but off-label marketing of drugs or devices is not. Advertising use of an FDA-approved drug or device for a purpose for which it is not approved is off-label marketing.

That Android price may be a short-term promotion, by the way: it's excellent value for under a couple of quid. 55 missions to play by yourself plus five multiplayer modes. It's a turn-based strategy game originally released for computers, as you guide your squad through a succession of levels. If you like a real challenge with your mobile games, then Frozen Synapse is an essential purchase. Which sounds slightly tortuous written down, but the game's genius is its stripped-down simplicity. Android: £1.99 / iOS: £1.99 HundredsĬircular puzzle game Hundreds sees you tapping on circles in each level to make them (and the numbers inside them) bigger – adding at least 100 points overall without them touching. Ridiculous Fishing is, yes, ridiculous: you lower your bait down as far as possible while avoiding a variety of creatures, then haul it back up again catching as many as possible along the way, hurl them into the air, and blast them to bits with a shotgun. Android: £1.99 / iOS: £1.99 Ridiculous Fishing Its pulsating chiptune music is also a standout mobile-game soundtrack. Super Hexagon may just be one of the most hardcore mobile games ever: a "minimal action" arcade game with a punishing difficulty level – yet intensely rewarding once you got to grips with it. Android: £4.99 / iOS: £4.99 Super Hexagon This latest game continues developer Revolution Software’s run, sending you on the hunt for a stolen painting with puzzles and a well-worked storyline to hold your attention. The Broken Sword games are marvellous: engrossing adventures that have navigated the path from PC to mobile with aplomb. Android: £7.14 / iOS: £6.99 Broken Sword 5: The Serpent's Curse Your job is to fend off an alien invasion with a squad of tooled-up soldiers, with an emphasis on tension and careful tactics rather than simply blundering around shooting anything that moves. One of the bargains on the app stores in terms of entertainment-per-quid, as this classic sci-fi strategy game makes its way to mobile. Android: £1.99 / iOS: £1.99 XCOM: Enemy Unknown “A physical puzzler, wrapped in a mystery game, inside a beautifully tactile 3D world,” as its developer puts it, this is carefully-crafted 3D puzzling posing a considerable challenge to your logic skills. The original The Room was one of the best puzzlers on mobile devices, and its sequel continues the quality. It’s brutally simple, yet once you’re in, you’ll find it hard to put your phone down. It involves swiping number tiles to make matches: adding 1s and 2s together, then 3s and upwards. Threes! is another mobile game guaranteed to make you go deep down the rabbit-hole of just-one-more-go addiction. Escher, it’s a collection of impossible-architecture puzzles, which you twist to explore. It’s a really good game, mind: inspired by the art of M.C. Monument Valley really is beautiful though, almost as much an artwork as it is a game. The word “beautiful” is hugely overused in connection with apps: usually it means “has nice menus”. And one last reminder: NOT a free-to-play hater! I could (and likely will) happily compile a list of 20 freemium favourites that won't leave you feeling cheated. Read on, and please do make your own recommendations in the comments section. The descriptions are adapted from my weekly best-new-apps columns for iOS and for Android, where paid, freemium and paymium games are all given a fair shout. Oh, and everything's recent, which is why there's no space for Minecraft: Pocket Edition. Second, no in-app purchases allowed, which chucks out some "paymium" (yes, ugh at that word!) games like Baldur's Gate Enhanced Edition, Football Manager Handheld 2014 and many more. First, all these games are available for both iOS and Android, which leaves out some excellent iOS-only titles – recent stars like Kiwanuka, FTL: Faster Than Light and Leo's Fortune, for example, as well as the bewitching Year Walk and Device 6. There are a couple of self-imposed restrictions. Here are 20 of the best paid mobile games in recent times: the kind I bang on about to friends who are reluctant to pay up front to play on their smartphones and/or tablets. They need support though: reviews and personal recommendations to help people get over that hump of having to pay before you play. What I do worry about, though, is the pressure that many developers feel to adopt the free-to-play model: the concern that if they don't ditch the idea of charging up front, their games will sink like stones on the app stores, and they'll go out of business.Īctually, paid games can make money still, even if – Minecraft aside – you usually won't find them in the upper reaches of the app store Top Grossing charts. We’ve also had fun mixing in some M&M’s and occasionally put sprinkles on top. They may be simple, but everyone who tries them LOVES them! No former president has ever been prosecuted before, a lack of historical precedent Trump's team has seized on in trying to get the indictment tossed out. The argument that Trump is immune from prosecution for actions taken within his role as president has for months been seen as perhaps the most weighty and legally consequential objection to the case made by the Trump lawyers ahead of trial. The appeals court is expected to schedule dates for written briefs and oral arguments, though it's not clear when those would be. It's part of a broader strategy by him and his lawyers to try to postpone the criminal cases against him until after next year's presidential election, averting trials that could unfold in the heat of the presidential campaign. The appeal had been expected given that Trump's lawyers had earlier signaled their plans to pursue all the way to the Supreme Court, if necessary, what they say is a legally untested question of a former president's immunity from prosecution. He added that Trump "has absolute immunity from prosecution, and litigation, for carrying out his sworn and solemn duties as President.” In a separate statement, Trump campaign spokesman Steven Cheung said one of Trump's "most sacred obligations and responsibilities as President was to ensure that the election process was conducted in a way that complied with the law, including investigating and challenging election fraud and irregularities." “Therefore, a stay of all further proceedings is mandatory and automatic.” “The filing of President Trump’s notice of appeal has deprived this Court of jurisdiction over this case in its entirety pending resolution of the appeal,” Trump's lawyers wrote. The one-page filing, the first step in a process that could potentially reach the Supreme Court in the months ahead, was accompanied by a request from the Trump team to freeze deadlines in the case while the appeals court considers the matter. Recently, Jleli and Samet established new blow-up results for a higher-order evolution inequality involving a convection term in an exterior domain of R n. The findings relate to government grants awarded to two organisations in Wagga Wagga – the Australian Clay Target Association and the Riverina Conservatorium of Music – being advanced by Maguire. On Thursday morning, Icac’s Operation Keppel – which was launched in 2020 to investigate the conduct of the former Wagga Wagga MP Daryl Maguire then later widened to include Berejiklian – concluded the former premier “breached public trust” and “substantially breached the ministerial code”. Such bodies however cannot be immune from reform and improvement if justice itself can be better served.“Thank you to members of the public for their incredible support. The establishment of independent corruption commissions, which started in NSW and will conclude with the commencement of its federal counterpart next month, have undoubtedly strengthened our capacity as a nation to deal with corruption. We need a much broader and mature discussion about how we defend the rights that are at the cornerstone of our legal system. Voters were perhaps instinctively striking a blow for that presumption of innocence. One recent example is the voters of the NSW state seat of Kiama who re-elected their MP in March this year despite knowing criminal proceedings were pending against that member. Whether that view is shared within the community is hard to test. Those with legislative responsibility for defending a fundamental right such as the presumption of innocence are reluctant to do so for themselves because of the perceived political consequences. Extensions might legitimately be required for complex inquiries but the onus for these should be on Icac to establish either before its inspector general or a supreme court judge.įor politicians, there is an unwritten rule that investigations of these types or, separately criminal proceedings, effectively means sudden death for a political career – certainly at the ministerial level or indeed a person’s capacity to continue in parliament. While a step forward, I would argue that it can go further and place a hard six-month deadline on completing reports at the conclusion of public hearings. This must change.įollowing a recent NSW parliamentary committee report, the new state government has indicated its willingness to consider requirements for Icac to self-publish timeframes for the completion of its investigations. For those holding public office, such uncertainty means that adopting the Wran approach of temporarily standing aside is effectively impossible. We have seen some of its inquiries, such as the Berejiklian example, take years and leave those subject to allegations in limbo. What is relevant about the Wran example is that such a major investigation was able to be conducted within a set and relatively short timeframe.Īpart from its internal KPIs, the NSW Icac is subject to no legislative requirements about the duration of its own investigations. Pre-Icac, royal commissions were often deployed to test allegations of serious corruption. Exonerated, Wran was able to resume his position as premier. Within three months eminent jurist Sir Laurence Street had conducted his royal commission which included two months of intense public hearings. The allegations, first aired by the ABC’s Four Corners program in 1983, suggested Wran had interfered in the proceedings of a court case against the then head of rugby league in NSW. When allegations of corruption levelled against former NSW Labor premier Neville Wran became too hard to ignore for even his legendary teflon political skills, Wran relented and established a royal commission and promptly stood aside. Very at odds with his light-hearted personality.įouse: Right?! And that's what it was. I was so satisfied that we got some more of where he came from, but then I was just like, "Damn, why is it so sad?" This was also a very heavy episode for M.G., so what was your first reaction when you found out the truth about M.G.'s parents?įouse: When I tell you I cried reading the script for the first time, I was just like, "Oh my gosh, man." It's heart-wrenching. He knows specifically what is needed in this realm, and I thought that was just a dope experience, experiencing the specificity of how he works. Paul Wesley knows specifically how to talk to me, being not only an actor on The CW but being an actor in The Vampire Diaries universe, you know what I mean? He is very conscious of the realm that he's working in, so the way he directs you is not like someone who would direct on, like, a Disney show. Was it nice having Paul Wesley directing to sort of show you the ropes? Quincy Fouse, Legacies Jace Downs, Jace Downs/The CW Hope's Former Flame on The Originals Will Appear on Legacies TV Guide spoke with Quincy Fouse about the huge revelation and the emotional impact his confrontation with his father will have on M.G. We finally have our answer, folks: Landon is a phoenix, a long-lived mythical creature that dies and then returns to life by rising from its own ashes. Never fear though! Landon's supernatural identity was finally revealed when, the next day, his body spontaneous burst into flames and he was reborn from the ashes, very much alive. lashed out at Landon, feeding on him and eventually killing him. and his father was as heartbreaking as a coming out allegory gets, and in his heightened emotional state, M.G. As it turned out, his father didn't even know he was alive since his mother hid the fact that he'd come back as a vampire, fearing it would conflict with her husband's devout faith. to confront them and finally get answers. After learning that M.G.'s parents never invite him home for the holidays, Landon ( Aria Shahghasemi) pushed M.G. Of course, in the case of Landon, it's because he was born from unusual circumstances however, if the series reveals another phoenix, Landon may have to die permanently.Legaciesjust delivered its strongest episode of an already solid first season, and to no one's surprise, it leaned heavily into the show's vampire elements and the human connections between all our non-human characters.ĭirected by Paul Wesley, the episode zeroed in on the one character we've been wanting to dig deeper into: M.G. This matches up with Landon's current state, as he is the only known phoenix to exist. Within that manuscript, the phoenix was said to be a rare creature that cannot exist simultaneously with others of its kind, meaning there can only be one phoenix in the world. Much of the phoenix myth seems to have been carried over for Landon's character in Legacies. The mythical beast was one of the animals featured in The Aberdeen Bestiary, a 12th Century manuscript that listed and described different types of animals, both real and imaginary. Related: Legacies Turns Field Day Into a Frightful Even in First S3 Photos Legacies could do something similar and have Landon's potential healing powers emerge when someone important to him dies, with his tears bringing them back. Rowling used this detail when creating Fawkes, Albus Dumbledore's pet phoenix, where his tears healed Harry from basilisk venom in Harry Potter and the Chamber of Secrets. Along with its immortality and regeneration, some mythologies have phoenixes heal others from fatal wounds, and they can even bring people back from the dead with their tears.
